Terms of Service

By accessing or using the GogpleAI application ("Service"), operated by GogpleAI (registered in New Mexico, USA) and Gogpleai LTD (registered in Nigeria), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to all the terms and conditions of this agreement, then you may not access the Service. These Terms apply to all visitors, users, and others who wish to access or use the Service.

GogpleAI is an AI-powered assistant that provides services including but not to intelligent chat, image generation, and file analysis. The Service is provided on an "AS IS" and "AS AVAILABLE" basis. We reserve the right to modify, suspend, or discontinue the Service at any time with or without notice.

To access certain features of the Service, you must create an account. You are responsible for safeguarding your account password and for any activities or actions under your account. You agree to provide accurate and complete information when creating an account and to keep this information up to date. You must be at least 13 years old to use the Service.

You retain all rights to and are solely responsible for the text, files, images, and other content you create, upload, or post on the Service ("User Content"). By creating User Content, you grant GogpleAI a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and distribute your User Content in connection with providing and improving the Service. You represent and warrant that you have all the rights, power, and authority necessary to grant the rights granted herein to any User Content that you submit.

You agree not to use the Service for any unlawful purpose or to engage in any of the following prohibited activities:

• Attempting to interfere with, compromise the system integrity or security, or decipher any transmissions to or from the servers running the Service.
• Uploading invalid data, viruses, worms, or other software agents through the Service.
• Using the Service to generate or disseminate illegal, hateful, or harassing content.
• Violating the privacy of others or infringing upon their intellectual property rights.
• Reverse engineering, decompiling, or otherwise attempting to discover the source code of the Service.

Certain features of the Service are available only through a paid subscription. All payments are handled by our third-party payment processor, Stripe. By purchasing a subscription, you agree to their terms of service. Subscriptions are billed on a recurring basis (weekly, monthly, or yearly) and will automatically renew unless canceled. You may cancel your subscription at any time through your billing portal. No refunds will be issued for the current billing period upon cancellation.

GogpleAI utilizes APIs from third-party services, including OpenAI. Your use of our Service is also subject to their respective terms and policies. By using GogpleAI, you agree to comply with the OpenAI Terms of Use and Privacy Policy.

The Service is provided without warranties of any kind. GogpleAI does not warrant that the Service will be uninterrupted, secure, or error-free, or that the results obtained from the use of the Service will be accurate or reliable. In no event shall GogpleAI, nor its directors, employees, or partners, be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of the Service. Our total liability to you for any claim arising out of or relating to these Terms or the Service is limited to the amount you paid to GogpleAI, if any, in the past 12 months.

These Terms shall be governed by the laws of the State of New Mexico, United States, for users residing outside of Nigeria, and by the laws of the Federal Republic of Nigeria for users residing in Nigeria, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms will be brought exclusively in the federal or state courts located in New Mexico, USA, or in the appropriate courts in Nigeria, respectively. The parties hereby irrevocably consent to the personal jurisdiction and venue therein.

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will provide at least 30 days' notice before any new terms take effect. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.
